This Terms of Service Agreement ("Agreement") is entered into by and between EE-Mobile, a company incorporated under the laws of the United Kingdom ("Service Provider", "we", "us", "our"), and the customer ("Customer", "you", "your"). This Agreement outlines the terms and conditions governing the provision of Internet access services ("Services") by the Service Provider.

By subscribing to or using our Services, you agree to comply with and be bound by this Agreement. If you do not agree to these terms, you may not use our Services.

Your Services will commence upon the successful activation of your account and connection to our network. Activation may take a few days depending on technical requirements, including the installation of necessary Equipment.

2.4 Service Limitations

While we strive to provide uninterrupted service, the Service Provider does not guarantee that the Services will be free from outages, errors, or delays, and we will not be held responsible for any interruptions or degradation of service beyond our control.

3. Customer Responsibilities

3.1 Accurate Information

You agree to provide accurate and complete information when registering for our Services. Failure to provide accurate information may result in delays, cancellation, or termination of the Services.

You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations, including but not limited to those relating to data protection, copyright, and intellectual property. You must not use the Services to:

We reserve the right to implement traffic management policies to ensure the fair use of the network, and we may suspend or terminate your Services if your usage is deemed excessive or violates this policy.

4. Service Plans and Payment

4.1 Service Plan Subscription

You agree to pay the fees associated with the selected Service Plan. The pricing, features, and terms of each Service Plan are available on our website or can be provided upon request. Prices are subject to change, but you will be notified of any changes prior to their implementation.

4.2 Billing and Payment

You agree to pay all charges in full according to the billing cycle set forth in your Service Plan. Payments will be billed monthly or annually, as applicable, and are due in advance. Accepted payment methods include credit/debit card, direct debit, or bank transfer.

4.3 Late Payments and Fees

If payment is not received by the due date, we may charge late payment fees or suspend your Services until payment is made. Reconnection fees may apply if your Services are suspended due to non-payment.

4.4 Refunds and Cancellations

In accordance with UK consumer law, you have the right to cancel your service within 14 days of signing up for the service, provided you have not yet used the Services. After this period, refunds will not be issued unless required by law or specific circumstances outlined in your Service Plan.

5. Termination of Service

5.1 By the Customer

You may cancel or terminate your Services at any time by notifying us through the appropriate channels (e.g., email, customer portal). Cancellation may be subject to a notice period and/or early termination fees if applicable under your Service Plan.

While we aim to deliver the speeds and performance outlined in your Service Plan, actual speeds may vary depending on factors such as network congestion, your location, and the type of Equipment used. We make no guarantees regarding maximum speeds.

6.2 Service Interruptions

The Service Provider may suspend or restrict access to the Services for maintenance, upgrades, or unforeseen technical issues. We will make reasonable efforts to notify you of any planned outages in advance.

6.3 Data Caps and Traffic Management

Depending on your Service Plan, data usage may be subject to limits or fair usage policies. We reserve the right to apply reasonable traffic management measures to ensure network fairness.

7. Privacy and Data Protection

7.1 Data Collection and Use

The Service Provider will collect and use personal data in accordance with our Privacy Policy, which is available on our website. We comply with the UK Data Protection Act 2018 and the General Data Protection Regulation (GDPR).

7.2 Security

We take reasonable measures to protect your data from unauthorized access and disclosure. However, we cannot guarantee the absolute security of data transmitted over the internet or stored on our systems.

We retain personal data only for as long as necessary to provide the Services and comply with legal obligations.

8. Modifications to Terms

Our total liability to you for any claim under this Agreement shall not exceed the amount you paid for the Services in the 3 months preceding the claim.

You agree to indemnify and hold harmless the Service Provider, its officers, employees, and agents from any claims, losses, liabilities, damages, or expenses arising from your breach of these Terms, including legal fees.

11. Governing Law and Dispute Resolution

This Agreement will be governed by and construed in accordance with the laws of the United Kingdom.

11.2 Dispute Resolution

Any disputes under this Agreement will be resolved through binding arbitration or mediation in the United Kingdom. In the event of a dispute, you agree to engage in informal dispute resolution procedures before escalating the matter to formal arbitration.

12. Miscellaneous

12.1 Force Majeure

The Service Provider is not liable for any failure or delay in performance due to events beyond its control, including natural disasters, power failures, strikes, or technical failures.

12.2 Severability

If any part of this Agreement is found to be invalid or unenforceable, the rest of the Agreement shall remain in full force and effect.

12.3 Entire Agreement

This Agreement constitutes the entire understanding between you and the Service Provider regarding the Services and supersedes any prior agreements or understandings, whether written or oral.
